The deal between you and drex. By using it, you agree to this. We have tried to write it the way we would say it out loud.

The place

What drex. is

drex. is a service for making and sharing scrapbooks with other people, in clubs, run by Drex, Inc. We may change how it works, and we will try not to break things you rely on.

Your account

Your account is yours to look after

You need to be at least 18 years old. Give us a way to reach you — an email address or a mobile number — keep it current, and do not let other people use your account. Anything done from your account is treated as done by you.

You can close your account whenever you like: delete it yourself from your account settings, or write to hi@drex.style from the address or number on the account and we will delete it, as our privacy page describes.

Your work

What you make stays yours

You own what you make here. We claim no ownership of your scrapbooks, your writing or your pictures.

So that the service can actually work, you give us permission to store, copy and display your content. A published scrapbook is public on drex. Anyone with the link, or who finds the page, can see it, and the club and drex. may show it on club pages and share cards. That permission is limited to running and showing drex. It covers nothing else, and it ends when you delete the content or your account, except for copies we are technically unable to remove immediately, such as backups.

Only upload work that is yours to upload, or that you have permission to use.

House rules

What you may not do

Do not use drex. to:

harass, threaten, or abuse anyone
post content that is illegal, or that sexualises children
post someone else’s work as your own, or breach their copyright
break into accounts, scrape the service, or try to knock it over
use it to send spam, or to collect other members’ details

You can report anything that breaks these rules from inside the app, or by emailing hi@drex.style. Reports reach a person, not a queue nobody opens.

Child safety

Zero tolerance for child sexual abuse

drex. does not allow child sexual abuse material, or anything that sexualises, grooms, exploits or endangers a child, anywhere on the service. When we find it or are told about it, we remove it, close the account that posted it for good, and report it to the National Center for Missing & Exploited Children (NCMEC), as US law requires. Report it from inside the app or at hi@drex.style. Our full child safety standards say how.

If your work turns up here without your say

Scrapbooks are collage, and collage borrows. Borrowing is fine when you have the right to. When you do not, the person whose work it is can ask us to take it down, and we will.

If you own the copyright in something on drex. that is being used without your permission, send a notice to our copyright agent, by email or by post:

For us to act on it, the notice needs six things: a link to where the work appears on drex., and enough for us to find it; which work of yours it infringes; how to reach you; a statement that you believe in good faith the use is not authorised by the owner, their agent or the law; a statement, made under penalty of perjury, that the notice is accurate and that you are the owner or are authorised to act for them; and your signature, written or electronic. That is the list the Digital Millennium Copyright Act asks for (17 U.S.C. §512(c)(3)), and a notice missing one of them may not be acted on.

When we get a complete notice we remove the material or disable access to it, and we tell the member who posted it. If that member believes it was removed by mistake, they can send us a counter-notice: their name, address and phone number; which material was removed and where it was; a statement, under penalty of perjury, that they believe in good faith it was removed by mistake or misidentification; their consent to the jurisdiction of the federal court for their district (or, outside the United States, for the Northern District of California) and to accept service from the person who complained; and their signature. We pass that to the person who complained, and unless they tell us within ten business days that they have gone to court over it, we may put the material back between ten and fourteen business days after we received the counter-notice.

A member who keeps posting other people’s work will lose their account. Sending a notice or counter-notice you know to be false can make you liable for the costs it causes.

Club dues

If a club charges dues

A host may set monthly dues for their club. When they do, the host is the seller: your membership agreement is with the host, not with drex., and the host decides what the dues cover and whether to refund them. Payments run through Stripe, on an account in the host’s own name; drex. never holds the money and never sees your card. Dues renew monthly until you cancel. You can cancel at any time from “manage dues” on the club page; a cancelled membership keeps its seat until the end of the paid month, and then it opens up. Leaving the club instead stops your dues straight away and gives up your seat now, with no refund for the rest of that month. If a payment fails, the seat is kept for 14 days while it is put right, and then it opens up.

drex. charges the host a platform fee of 10% of each payment. A host who collects dues accepts Stripe’s connected account agreement during Stripe’s setup, is responsible for any tax on what they collect, and must keep their Stripe account connected to drex. for as long as any member is paying through it — disconnecting it leaves those members paying with no way for us to stop the charge, which is on the host to put right. Dues are for adults: every Drex account is 18 or older, hosts and paying members included.

Consequences

When we step in

If something here breaks these rules we may remove it, and if an account keeps breaking them we may suspend or close it. Where we can, we will tell you what happened and why, and you can reply to us about it. Serious or illegal cases may be acted on immediately.

The small print

What we do and do not promise

We work hard to keep drex. running and your work safe, but the service is provided as it is. We do not promise it will be uninterrupted or error-free, and we do not promise that it will never lose data — keep your own copies of anything you would be upset to lose.

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profit or data. Nothing here takes away a right you have that the law says you cannot sign away.

Changes

Changes, and the law

We may update these terms. If a change matters we will say so on this page and change the date at the bottom. Carrying on using drex. after that means you accept the new version.

These terms are governed by the laws of the State of California, and disputes will be dealt with by its courts.
